Terms of use
These terms are an agreement between you and Spikewave Pty Ltd (“we”, “us”) covering your use of the Stopby application. By installing or using Stopby you agree to them. If you do not agree, please do not use the app.
Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Stopby on devices you own or control, for your own purposes. You may not resell, rent out, reverse-engineer or redistribute the app, or attempt to extract its source code, except where that restriction is prohibited by law.
Acceptable use
You agree not to:
- use the app for anything unlawful, or to infringe anyone else’s rights;
- interfere with, overload or attempt to gain unauthorised access to our systems;
- use automated means to access the app in a way that degrades it for others.
Payment
Stopby is free during launch, with every feature included, and nothing in the app can be bought yet.
Some features will later move to an optional paid tier, Stopby Pro. Before any payment is possible, these terms will be updated to cover pricing, renewal, cancellation and refunds, and you will be told in the app. Features you already use will not simply stop working: early users keep them free for a while after Stopby Pro arrives.
Availability
We work to keep Stopby available and accurate, but we provide it “as is”. We do not guarantee uninterrupted service, and we may change, suspend or discontinue features. Where a change materially reduces what the app does, we will give reasonable notice.
No warranty
To the fullest extent permitted by law, the app is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose. Nothing in these terms excludes rights you have as a consumer that cannot lawfully be excluded — including under the Consumer Protection Act in South Africa.
Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of data arising from your use of Stopby. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim.
Your content
Anything you enter into Stopby remains yours. We claim no ownership of it and use it only as described in the privacy policy.
Ending these terms
You may stop using Stopby at any time by uninstalling it. We may end this licence if you materially breach these terms.
Changes to these terms
We may update these terms as the app changes. The revision date at the top always reflects the current version, and continued use after an update means you accept it.
Governing law
These terms are governed by the laws of the Republic of South Africa, and disputes are subject to the jurisdiction of its courts.
